We do not warrant that the website will be error-free, secure, uninterrupted, current, complete, or free from viruses or harmful components.
We do not warrant or guarantee any specific outcome from donations, prayers, ministry content, religious communications, website use, or participation in church-related activities.
To the fullest extent permitted by law, Keystone Christian Church and its officers, directors, employees, volunteers, ministers, agents, representatives, contractors, service providers, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including loss of data, loss of goodwill, loss of opportunity, emotional distress, reputational harm, lost profits, or other intangible losses arising out of or related to your use of the website, donations, communications, content, account features, third-party services, or these Terms.
To the fullest extent permitted by law, Keystone Christian Church’s total liability for any claim arising out of or related to these Terms, the website, donations, communications, or related services will not exceed the greater of:
The amount you donated to Keystone Christian Church in the three months before the claim arose; or
$100.
Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, the limitation will apply to the fullest extent permitted by law.
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Keystone Christian Church and its officers, directors, employees, volunteers, ministers, agents, representatives, contractors, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, expenses, demands, actions, or proceedings, including reasonable attorneys’ fees, arising out of or related to:
Your use of the website;
Your violation of these Terms;
Your violation of any law or third-party right;
Your User Submissions;
Your misuse of donation, refund, cancellation, chargeback, account, or communication features;
Any false, inaccurate, misleading, unlawful, or unauthorized information you submit.
To the fullest extent permitted by law, you and Keystone Christian Church agree that any dispute, claim, controversy, or cause of action arising out of or relating to these Terms, the website, donations, recurring donations, communications, privacy practices, User Submissions, or your relationship with Keystone Christian Church will be resolved through final and binding arbitration on an individual basis, rather than in court, except as stated below.
This arbitration agreement is governed by the Federal Arbitration Act.
You and Keystone Christian Church agree that disputes will be arbitrated only on an individual basis. You and Keystone Christian Church waive any right to bring or participate in a class action, class arbitration, collective action, representative action, private attorney general action, or consolidated proceeding.
The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.
Arbitration will be conducted in Pinellas County, Florida, unless the parties agree to remote/video arbitration or another location.
The arbitration will be administered by the American Arbitration Association or another mutually agreed arbitration provider under the applicable consumer or commercial arbitration rules, depending on the nature of the dispute.
Either party may bring an individual claim in small claims court if the claim qualifies.
Keystone Christian Church may seek injunctive or equitable relief in court for claims involving unauthorized access, misuse of the website, intellectual property infringement, fraud, security threats, or conduct that may cause irreparable harm.
Nothing in these Terms prevents either party from reporting concerns to a government agency or cooperating with a government investigation.
You may opt out of this arbitration agreement by sending written notice within 30 days after you first become subject to these Terms.
Your opt-out notice must include your name, email address, mailing address, and a clear statement that you wish to opt out of arbitration under Keystone Christian Church’s Terms and Conditions.
Send opt-out notices to:

Attn: Arbitration Opt-Out

Opting out of arbitration does not affect any other part of these Terms.
To the fullest extent permitted by law, if any dispute proceeds in court rather than arbitration, you and Keystone Christian Church waive the right to a jury trial.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
To the extent any dispute is not subject to arbitration, the parties agree that the exclusive venue for any lawsuit or court proceeding will be the state or federal courts located in or serving Pinellas County, Florida, including the United States District Court for the Middle District of Florida where federal jurisdiction exists.
You consent to personal jurisdiction and venue in those courts.
Keystone Christian Church may update these Terms at any time.
Changes will be effective when posted on the website unless otherwise stated. The “Last Updated” date at the top of these Terms indicates when they were last revised.
Your continued use of the website, creation or maintenance of an account, submission of information, or making of donations after changes are posted constitutes acceptance of the updated Terms.
Keystone Christian Church may suspend, restrict, or terminate your access to the website, account features, communications, donation features, or related services at any time and for any reason, including if we believe you have violated these Terms, submitted false information, engaged in fraudulent or abusive conduct, created legal or security risk, or acted inconsistently with our mission or applicable law.
The provisions of these Terms that by their nature should survive termination will survive, including provisions related to donations, disclaimers, limitation of liability, indemnification, arbitration, intellectual property, governing law, and user submissions.
You agree that Keystone Christian Church may communicate with you electronically, including by email, website notice, SMS, account notice, or other electronic means.
You agree that electronic communications satisfy any legal requirement that communications be in writing, to the extent permitted by law.
You may not assign or transfer your rights or obligations under these Terms without Keystone Christian Church’s prior written consent.
Keystone Christian Church may assign or transfer these Terms, in whole or in part, in connection with a reorganization, restructuring, transfer of ministry operations, merger, consolidation, or similar organizational event.
No waiver by Keystone Christian Church of any term or condition will be deemed a further or continuing waiver of that term or any other term.
Failure by Keystone Christian Church to enforce any provision of these Terms does not constitute a waiver of that provision.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary.
The remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, Donation Terms and Disclosures, and any other policies posted on the website or presented during the donation process, constitute the entire agreement between you and Keystone Christian Church regarding your use of the website, donations, accounts, communications, and related services.
